Terms
Last updated 1 October 2026. Written by the founder, not a lawyer. Questions: hello@thenivala.com or Instagram.
You create your café yourself at https://thenivala.com. Setting up and practising are free; you set a password and open Chrome or Edge on the PC, laptop or tablet you already own. We do not sell hardware.
Price and paying
There is no free trial. Setup and practice are free. You pay when you go live. Starter is ₹999 a month per café. Plus is ₹1,299 a month per café. This is the final amount. GST is not charged, because Nivala is not registered under GST. Pay monthly. No setup fee. No annual plan. Payment goes through Razorpay. The first month is charged when you choose a plan and pay. You go live after your first payment is verified.
Your plan renews automatically every month and we charge your saved payment method on each renewal date until you cancel. Cancel any time from Back office → Nivala Subscription in the app; it stops the next charge.
Change plan any time; the change starts from the next month, with no part-month charge. If a monthly payment fails, you have three days to fix it; after that new orders pause and your records stay readable and downloadable. If we register for GST, we’ll give you 30 days’ notice of any price change.
Refunds and cancelling
- Monthly fees already paid are not refunded.
- You can cancel any time; you keep access until the end of the month you paid for.
- If we charge you twice or charge the wrong amount, we refund the extra in full within 7 working days.

The product
Orders at the counter, a kitchen screen on both plans, GST bills you can view, download or print (a printer is optional), cash, UPI and card recorded by staff, shift close, expenses, CSV downloads and the owner dashboard. Plus adds ingredients, recipes and an estimated cost view that says it is not audited. Nivala needs the internet: a sale counts only once our server confirms it. If the internet stops, new orders pause. Your guests pay into your own UPI or card machine; we record what staff entered and do not check it with your bank. Nothing is shipped; you sign in with your email.
Your part
Staff PINs, correct GST details and your own devices are your responsibility. We may pause access for misuse or unpaid months. These terms are not advice from your CA.
Your café is responsible for its own tax filings, and for setting up the tax on its bills correctly: GST registration type, rates and item tax settings. Nivala prints bills from the details you enter; please check them with your CA.
What you must not do
- Use Nivala for anything against the law, or to bill for goods or services your café does not really sell.
- Try to get into another café’s records, break or overload the app, or copy or resell it.
- Share your sign-in or staff PINs with people who do not work for your café, or enter other people’s details without the right to.
Your café’s data is yours
What your café enters, such as the menu, orders, bills, expenses and guest details, belongs to your café. We do not claim it. You let us store and use it only to run Nivala for your café. You can download your records as CSV at any time, also after you cancel.
Guest and staff data we handle for you
Your café decides why and how its guests’ and staff’s details are collected. Nivala handles them on your café’s behalf, under these terms.
- Purpose: we use that data only to run Nivala for your café, to support you when you ask, and to keep it safe. Never for our own marketing.
- Secrecy: only the people who need it to run or support Nivala can see it, and they must keep it private.
- Safety: it is sent over HTTPS and backed up in encrypted form. If we find that it was lost or seen by someone it should not have been, we tell you at your account email without undue delay.
- Who else handles it for us: Render (runs the app and database, Singapore), Backblaze (encrypted backups, USA), Resend (sends emails, USA) and Google Gemini (reads a menu photo, only if you add your menu that way). If we add or change one, we update the Privacy page.
- Where it is stored: Singapore, with encrypted backups in the USA.
- When you leave: you can download your records as CSV, and on request we delete your café’s data, except bills, payments and tax records that Indian law says we must keep (at least 8 years).
Pausing or ending access
We may pause or end access for misuse, for breaking these terms, or for unpaid months. Unless we must act at once to protect the service or other cafés, we email you first, say why, and give you a chance to put it right. Your records stay readable and downloadable.
Changes to these terms
When we change these terms, we put the new version on this page with a new “Last updated” date. For a change that matters, such as price or what you owe, we email your account address at least 30 days before it applies. If you do not agree, you can cancel before it starts. If you keep using Nivala after it starts, the new terms apply.
Availability
Nivala is online software run by one person. We work to keep it running, but we do not promise it is always available, and we do not promise an uptime figure. We may pause it for a short time for fixes or updates, and tell you when we can. Support is hello@thenivala.com, Monday to Saturday, 10 am to 7 pm IST. Not 24/7.
What Nivala does not do
- There is no service-charge line on the bill. If your café adds one, enter it as a menu item and check its GST with your CA.
- Nivala does not make an e-invoice or print an IRN. A café above the e-invoicing limit needs another tool; check your limit with your CA.
- Nivala does not file or prepare your GST returns. You get CSV downloads for your CA.
- Nivala does not make a bill or tax invoice for orders that come through delivery apps such as Swiggy or Zomato. You can type or paste each one at the counter so the kitchen gets it and it is in the day’s numbers. Ask your CA how to record the tax.
- Every bill is a sale within your café’s own state. Sales to other states are not supported.
Limits on what we owe you
Our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim.
We are not responsible for indirect losses, such as lost profit, lost sales, lost business or lost goodwill, even if the app was down or a record was wrong. Nothing in these terms takes away rights that Indian law says cannot be taken away.
Which law applies
These terms are governed by the laws of India. If we cannot sort out a disagreement by talking, it goes to the courts of the city of our registered business address in India (printed on every subscription invoice).
Who runs Nivala
Nivala is a sole proprietorship in India, run by its founder. Our legal name and registered business address are printed on every subscription invoice; email us and we will send them.
